A man has been sentenced to four years in prison after being found guilty of causing death by dangerous driving.

27 year old Julian Ellul collided with a motorbike when turning off Queensway Road to enter a petrol station. The driver of the motorbike died two days later.

Defence lawyer, Chris Finch reiterated the agreed fact during the trial that there were serious shortfalls in the quality of medical care afforded to the victim whilst an inpatient at St Bernard's Hospital, which played a significant role in his death.

When sentencing, Chief Justice Anthony Dudley said that Ellul’s previous convictions showed the defendant had significant disregard for road users, adding it was only a matter of time before someone suffered serious injuries or death.

Justice Dudley also disqualified Ellul from driving for six years.

Mr Justice Dudley also told the court he would be sending a certificate of conviction and a copy of his sentencing notes to the coroner who, he said, would no doubt consider any shortcomings there may have been in the treatment afforded to the victim at st Bernard's Hospital.
