The Government has issued a Technical Notice to clarify how the recently changed Immigration Regulations affect EU, EEA EFTA and Swiss nationals whose rights are protected under post-Brexit agreements.
Officials say the temporary pause on new residency applications does not apply to people whose rights are safeguarded under the EU Withdrawal Agreement, the EEA EFTA Separation Agreement or the Swiss Citizens’ Rights Agreement.
These protections remain in force through the EU Withdrawal Act 2020, which continues to give legal effect to the Citizens’ Rights provisions.
The Notice stresses that UK citizens and nationals of other countries are not covered by this guidance.
